NEW Wildlife Protection Ordinance
Title 8.14 Wildlife Protection Ordinance will go into effect on September 1, 2025
This is not the full and complete ordinance, only a brief overview of some of the changes.
It is the intent of the Town Council adopting this Chapter to protect and maintain wildlife in the Town of Eagle and surrounding areas and to minimize the risk of dangerous interaction between humans and wildlife caused by refuse and feeding.
All refuse containers defined in this Chapter shall be kept closed and secured when refuse is not being deposited.
Any container which is so full as to prevent a container from closing and latching as designed is not a wildlife-resistant or wildlife-proof refuse container within the meaning of this Chapter.
If a wildlife-resistant or wildlife-proof refuse container is damaged to the extent that the locking mechanism now allows access by wildlife to the container, repairs or replacement must be made, or the container company must be notified in writing by the container renter within 24 hours that the container is damaged and needs to be repaired or replaced.
Compost containers must be in compliance with this Chapter and must be a certified wildlife-resistant refuse container.
Multi-family housing developments and other types of clustered residential housing utilizing centralized refuse containers must use either a wildlife-proof or Wildlife-resistant refuse container or a wildlife-resistant enclosure for all refuse and attractants. The container or enclosure shall be kept closed and secured, except when refuse or attractants are being deposited.
All refuse containers receiving refuse and attractants from commercial establishments and restaurants shall be wildlife-resistant or wildlife-proof containers. Notwithstanding the foregoing, this requirement shall not apply to municipal refuse containers which are emptied every day or multiple times per day.
All construction sites must have a designated refuse container that receives refuse, or attractants as defined by this Chapter. This container shall be a wildlife-resistant or wildlife-proof refuse container, not including standard construction waste such as but not limited to wood and metal.
No person shall intentionally or unintentionally feed or provide food in any manner for wildlife on public or private property within the Town. Persons will be considered to be in violation of this Chapter if they leave or store any garbage, refuse, attractants or food product in a manner that would create an attraction for wildlife.
No person shall leave or store any refuse, attractant, food product, pet food, grain or minerals in a manner which would constitute a lure, attractant or enticement for wildlife between the dates of April 15 and November 15. All bird feeders must be suspended on a cable or other device so that they are inaccessible to bears, and the area below the feeders must be kept free from the accumulation of seed debris.
Residents with curbside pick-up shall only place containers at the curb, alley or public right of away on or after 6:00am MST the day of pick-up. After pick-up, all containers must be retrieved/removed from the curb, alley or public right of way on or before 7:00pm MST the day of pick-up.
All refuse and compost containers that are placed at the curb, alley or public right-of-way for collection must have the residence street address and unit number permanently affixed to the container with letters and/or digits no smaller than two (2) inches in height.
Penalty Violation
$100 to $250 Fine First Offense
$250 to $1000 Fine each successive violation within 12 months of any previous violation of this Chapter 8.14
